CONDITION OF SALES
REPRESENTATIONS AND WARRANTIES. NATIONAL LIGHTER MUSEUM SHOPPING MALL,aka NLM, represents and warrants for the benefit of the buyer of the applicable Property on the NLM SHOPPING MALL Site that: NLM has the right and authority to offer and sell the Property; the Property is, and shall remain free and clear of all liens, encumbrances or claims of third parties of every kind or nature whatsoever; good title will pass to the purchaser upon sale; the Information provided by NLM is accurate and not misleading and the physical condition of Property is as described on the NLM SHOPPING MALL by NLM based upon a fair and impartial evaluation of the condition as a whole and to the best of our knowledge. PACKING AND SHIPPING. Unless otherwise agreed by NLM and buyer, NLM will arrange for buyer the packing and handling of the purchased Property by a carrier and/or packer of NLM's choosing, and will insure the Property against loss or damage in an amount no less than the selling price. Buyer will bear the cost of shipping, insurance and any import-export tax fees. NLM is not liable for any acts or omissions of carriers of packers. Such carriers or packers may carry their own insurance and any claim for lost or damage should be addressed directly to them. PAYMENT. The purchaser shall pay by: credit card, cashier's check, money order, with approved credit. Payment will not be deemed to have been made and shipment will not be initiated until NLM has collected in full. NLM's liability shall be limited to refunding the amount received by NLM for the Property, and shall in no event include any incidental or consequential damages. RESCISSION. NLM agrees to cancel any sale and return all proceeds, for a period of thirty days (30 DAYS) from the date the Property is sold, to any purchaser who reasonably demonstrates that the Information provided with respect to the Property purchased has been incorrectly described, if the physical condition of Property is not as described in the Information The foregoing rights of rescission are available to the original purchaser only and may not be assigned to or relied upon by any subsequent transferee of the Property sold. In order to receive a return of all proceeds, purchaser must return the Property to NLM in the same condition it was received. LIMITATION OF LIABILITY. PURCHASER EXPRESSLY ACKNOWLEDGES AND AGREES THAT NLM SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOST PROFITS (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THE SALE OF PROPERTY ON THE NATIONAL LIGHTER MUSEUM SHOPPING MALL.
